Terms of Service

1. About 10xAgent

10xAgent (“we”, “us”, “our”) is an AI communication platform operated by Hivemind Labs Pty Ltd (ABN 71 687 556 921).
We provide automated messaging, booking, and follow-up services across SMS, email, and chat channels.

By using 10xAgent, you (“Customer”, “you”, “your”) agree to these Terms of Service.

2. Your Agreement

By creating an account or connecting your communication channels, you agree to:

  • Use 10xAgent in compliance with Australian law.
  • Ensure any data or content you provide is accurate and lawful.
  • Be responsible for all activity under your account.
  • Keep your credentials secure.

If you do not agree, you must not use 10xAgent.

3. Our Services

10xAgent provides AI-assisted automation for customer communication, lead response, appointment management, and support.
We may update, modify, or discontinue features from time to time.

We aim for high uptime but cannot guarantee uninterrupted availability due to maintenance or third-party service dependencies (e.g., AWS, Twilio).

4. Acceptable Use

You agree not to:

  • Send spam or unsolicited messages.
  • Use 10xAgent to mislead, harass, or defraud.
  • Attempt to gain unauthorised access to our systems.
  • Copy, reverse-engineer, or misuse our software or data.

We reserve the right to suspend or terminate accounts that breach these terms.

5. Data and Content

You own all data and content you provide.
You grant 10xAgent a limited licence to process and store your data solely to operate and improve the service.

We will never sell or monetise your data.

6. Fees and Payment

Subscriptions are billed in advance.
All fees are non-refundable except as required by Australian Consumer Law.
We will provide at least 30 days’ notice for any pricing changes.

7. Limitation of Liability

To the extent permitted by law:

  • 10xAgent is provided “as is” without warranties.
  • Hivemind Labs is not liable for indirect or consequential losses.
  • Total liability for any claim is limited to the fees paid in the past 12 months.

These terms do not limit your rights under the Australian Consumer Law.

8. Termination

You may cancel your account at any time.
We may suspend or terminate access if you breach these terms or misuse the service.

Upon termination, we may retain data only as necessary for compliance or backup purposes.

9. Governing Law

These Terms are governed by the laws of New South Wales, Australia.
Disputes will be handled in the courts of NSW.
